In short
This English text is a convenience translation. Only the French and Dutch versions have legal force.
Kadoz connects private individuals who give things away with private individuals who come and collect them. We hold no object, attend no handover, and are party to no gift.
The gift is concluded directly between the giver and the recipient. Ownership and risk pass to the recipient the moment they take the object in hand.
Everything is free, and will stay free for residents. Asking for anything in return, in any form, is prohibited.
Language of this version
This English text is a translation provided for your convenience. Only the French and Dutch versions of these documents have legal force; in case of any discrepancy, divergence of interpretation, or dispute, the French or Dutch version prevails.
The articles below carry the same numbers as the French version, so that any reference remains usable. Both authoritative versions are available in the app and on kadoz.app.
1. Purpose of these terms
These terms govern the use of the Kadoz app and website, published by GM Concept SRL, hereinafter "Kadoz".
Using the service, even without creating an account, constitutes acceptance of these terms. If you do not accept them, do not use the service.
These terms constitute the entire agreement between you and Kadoz regarding the service. They create no contract between Kadoz and you concerning any given object: that contract is formed between the giver and the recipient, and between them alone.
2. What Kadoz is, and what it is not
Kadoz is an introduction service. It allows a private individual to announce that they are giving an object away, and another private individual to learn of it and contact them.
Kadoz is neither a seller, nor a giver, nor a recipient, nor a carrier, nor a custodian, nor an agent of any party. At no point does Kadoz hold the objects, inspect them, handle them, arrange or supervise their handover, or attend any meeting.
Kadoz does not verify users' identities, nor the accuracy of the information they publish, nor the actual condition of the objects, nor the lawfulness of holding or circulating them.
The contract of gift is formed directly and exclusively between the giver and the recipient. Kadoz is not a party to it and guarantees neither its conclusion, nor its performance, nor its quality.
3. Status as a technical intermediary
Kadoz acts as a hosting service within the meaning of Article 6 of Regulation (EU) 2022/2065 on a Single Market for Digital Services. The content published — photographs, titles, descriptions, questions, messages — is supplied by users and stored at their request.
Kadoz exercises no prior editorial control over this content and is under no general obligation to monitor it. Kadoz is therefore not liable for content published by users, except from the moment it has actual knowledge of manifestly illegal content and fails to act expeditiously to remove it.
Point of contact for any notification of illegal content: hello@kadoz.app. Anyone may also report an object or a profile from within the app, in a few taps.
Kadoz undertakes to examine every notification and to act diligently. Decisions to remove content or suspend an account are reasoned and communicated to the person concerned, who may challenge them at the same address.
4. Who may use Kadoz
The service is restricted to natural persons aged at least 16, acting strictly in a personal and non-professional capacity, and holding a valid email address.
The gifts offered on Kadoz are gifts between private individuals. Professional use of the service — to clear stock, to feed a resale business, or for commercial purposes of any kind — is prohibited.
Each person may hold only one account. The username becomes permanent once confirmed: that is what gives meaning to the gift counter attached to it, and what prevents someone from accumulating a poor reputation and then changing name.
You are responsible for keeping access to your account confidential and for all activity that takes place on it.
5. Free of charge
The service is free for users. It will remain so: no giving or collecting feature will be made subject to payment.
Objects published on Kadoz are given away. No consideration may be requested or accepted, in any form whatsoever: money, exchange for another item, provision of a service, contribution towards costs, tip, or donation to a third party.
Publishing an object with a view to obtaining consideration, or soliciting consideration during an exchange, constitutes a serious breach resulting in deletion of the account.
Any costs you incur in travelling, transporting or storing an object remain yours, with no recourse against the giver, the recipient or Kadoz.
6. Legal nature of the gift
Handing over an object through Kadoz constitutes a manual gift (don manuel / handgift) of corporeal movable property, validly formed by delivery, that is to say by physically passing the object from hand to hand or by making it available in a manner that is accepted.
Transfer of ownership and transfer of risk both occur at the moment of that handover. From that instant, the recipient is the sole owner of the object and alone bears its risks, its use, its maintenance, its safekeeping and, where applicable, its disposal.
Where an object is left out for self-service collection, it is deemed handed over when the recipient takes possession of it, whether or not anyone else is present.
The gift is final. Neither the giver nor the recipient may demand its return or its cancellation through Kadoz.
As this is a gratuitous disposition, the giver's warranty is reduced to its simplest expression: the giver owes no warranty for hidden defects, for quantity, or for value or fitness for any particular purpose. The giver does however answer for fraud (dol), that is to say for the intentional concealment of a defect or danger of which they were aware.
7. The giver's obligations
You warrant that you own the object you publish, or that you are entitled to dispose of it, and that handing it over breaches no applicable rule.
You describe the object truthfully and completely: whether it works, how it looks, its dimensions, and any defect or danger you are aware of. The photographs you publish must depict the actual object.
You undertake not to publish any object that is dangerous, defective to the point of presenting a risk, recalled by its manufacturer, or whose transfer is prohibited or regulated. The list in article 8 is not exhaustive.
You share your address when you see fit. Accepting a request opens the conversation; it does not disclose your address. You may agree on another handover location, or withdraw a shared address as long as the object has not been handed over.
You inform the recipient of any known danger before the handover. Concealing a danger engages your liability, including criminal liability.
You undertake to withdraw your listing as soon as the object is no longer available, and not to leave an object obstructing public space or the common areas of a building for any length of time.
You respect the agreed place and time. A failure to attend the agreed meeting is recorded; three recorded no-shows suspend your ability to publish for fourteen days. A no-show can be counted against you only if you had answered the request: silence is not a no-show.
8. Objects that may not be given away
Asbestos and construction materials liable to contain it; paints, solvents, oils, acids and other chemical products; gas cylinders and pressurised containers; fuels and flammable substances.
Foodstuffs; medicines, medical devices and food supplements; opened cosmetic products.
Weapons, ammunition, imitation weapons, pyrotechnic articles.
Live animals, plants subject to restrictions, protected species and products derived from them.
Child car seats, helmets and protective equipment that have sustained an impact or whose history is unknown; recalled or non-compliant childcare articles; second-hand cots and infant mattresses.
Electrical appliances with defective insulation, a damaged cable, or a risk of electrocution or fire.
Counterfeit goods, stolen items or items of doubtful origin, identity documents, copyright-protected content reproduced without authorisation.
Any object whose possession, circulation or transfer is prohibited or subject to authorisation under Belgian or European law.
An object reported as dangerous by several users is automatically withdrawn from circulation, without waiting for moderation to review it. That measure is precautionary and does not prejudge the final decision.
9. The recipient's obligations
Reserving an object commits you to coming to collect it. As long as the giver has not accepted your request, you may withdraw it without consequence.
After acceptance, a late withdrawal or a failure to attend the agreed meeting is recorded. Three recorded no-shows suspend your ability to reserve for fifteen days.
Acceptance of your request does not oblige the giver to disclose their address. They share it if they wish; failing that, you agree on a handover location together by message.
You examine the object before taking it away. Once you have taken it, you own it and bear its risks: you have no recourse against the giver for a defect that examination would have revealed.
You undertake not to plug in or use an electrical appliance listed as faulty or in need of repair before having it checked.
You undertake not to resell objects collected on Kadoz on a professional basis. Occasionally reselling an object you turned out not to need is not covered; organised collection for the purpose of resale is.
You respect the agreed place and time, and the giver's home.
10. The meeting
Handing over an object brings together two people who do not know each other. Kadoz is not present, does not monitor the meeting, and cannot intervene in it.
It is for you to assess the circumstances and take whatever precautions you consider useful: favouring daylight hours, telling someone close to you, bringing company, or walking away if the situation makes you uncomfortable.
You alone are responsible for your safety, for that of anyone accompanying you and for your belongings during the meeting, as well as for loading, transporting and unloading the object.
In the event of inappropriate behaviour, leave and report the person from within the app. In the event of an offence, contact the police: Kadoz will cooperate with the authorities on the terms provided by law.
11. Your content
You retain the rights in the photographs and texts you publish. You grant Kadoz, for the duration of publication and free of charge, the right to reproduce and display them within the service, for the sole purpose of operating it.
You warrant that you hold the necessary rights in what you publish, and that your content infringes no third-party right, in particular individuals' image rights.
The conversation thread is there to agree on the handover arrangements. Public questions are there to clarify an object. Any other use — canvassing, commercial solicitation, harassment, discriminatory, hateful, threatening or obscene remarks — is prohibited.
You may block another user: you will no longer see their objects, and they will no longer see yours.
12. Kadoz's liability
Kadoz provides an introduction platform. Its obligation is a best-efforts obligation (obligation de moyens) relating to the availability and proper functioning of the service, to the exclusion of any undertaking as to what happens between users.
Kadoz is not liable for: the condition, safety, conformity, origin or value of the objects; the accuracy of listings; users' conduct; the course or failure of a handover; personal injury or property damage occurring during a meeting, during transport or in the use of an object; disputes between users.
Kadoz does not warrant that the service will be available without interruption or error, nor that a published object will find a taker, nor that a sought-after object will be available.
These limitations do not apply to fraud (dol), gross negligence or wilful misconduct on the part of Kadoz or its employees, nor to loss resulting from injury to life or physical integrity, in accordance with Article 5.89 of the Belgian Civil Code. They do not affect the mandatory rights you hold under the law.
Within the limits permitted by law, Kadoz's liability is in any event limited to direct and foreseeable loss, excluding any indirect loss such as loss of business, loss of opportunity or non-material damage.
13. Reporting, moderation and appeals
Any user may report an object or a profile from within the app, stating a reason. Anyone, user or not, may notify illegal content to hello@kadoz.app.
Kadoz examines reports and may, depending on the case: withdraw an object from circulation, warn a user, suspend an account for a set period, or delete it in the event of a serious or repeated breach.
Every decision to remove content or suspend an account is reasoned and communicated to the person concerned, setting out the alleged facts and the possibility of challenging the decision.
An appeal is made in writing to hello@kadoz.app, within thirty days of the decision. Kadoz re-examines the file and replies within a reasonable time. This internal appeal deprives you of no judicial remedy.
A report that is manifestly abusive or made in bad faith may itself give rise to a sanction. Reports are limited to five per day per account.
14. Suspension and end of the relationship
You may stop using the service at any time and delete your account from your profile.
Kadoz may suspend or delete an account in the event of a breach of these terms, of conduct endangering the safety of persons, or of fraudulent use of the service.
Deleting an account withdraws any current listings and informs the people who had reserved them. Diverted volumes remain counted anonymously in the municipal statistics.
15. Personal data
The processing of your personal data is described in the privacy policy, which forms an integral part of these terms.
Two points are worth repeating here. Your exact address is never public: on the map, your object appears about 150 metres from its real position, and you alone decide whether to share it, including after accepting a request. And the metadata of your photographs, GPS coordinates included, is stripped before upload.
16. Intellectual property
The Kadoz name, the logo, the visual identity, the category illustrations, the texts and the code of the service are protected. Any reproduction, adaptation or exploitation without written authorisation is prohibited.
Automated extraction of all or part of the service's content, in particular by scraping, is prohibited.
17. Changes to these terms
These terms may be amended, in particular to take account of legal developments or of new features.
Any substantial change will be flagged to you in the app at least fifteen days before it takes effect. Continuing to use the service after that date constitutes acceptance. If you refuse the new terms, you may delete your account.
18. Governing law and disputes
These terms are governed by Belgian law.
If something goes wrong, write to hello@kadoz.app first: most situations are settled that way.
If you are a consumer, you may refer the matter free of charge to the Consumer Mediation Service (Service de médiation pour le consommateur / Consumentenombudsdienst), boulevard du Roi Albert II 8 box 1, 1000 Brussels, or use the European online dispute resolution platform.
Failing agreement, the courts of the judicial district of Brussels have jurisdiction, without prejudice to the mandatory rules protecting consumers, who may also bring proceedings before the court of their own domicile.
Should any provision of these terms be held void or unenforceable, the remaining provisions would remain in full force.
